DISCRIMINATION AGAINST WOMEN IN THE PROVISIONS OF PUNITIVE TEXTS (A comparative study between the Iraqi and Lebanese laws)

Abstract

The United Nations Charter, adopted in 1945, is the first to refer to the equality of men and women in rights. The United Nations has consistently eliminated discrimination against women and international resolutions have been passed to improve the status of women and promote their rights. Equality is the cornerstone of any democratic society that aspires to justice Social and human rights. In this context, States have sought to achieve equal rights under their laws by joining international conventions and passing their texts which approved the rights of women and at other times by amending their domestic laws which did not provide for adequate guarantees for women. To apply its legal texts without paying any attention to the domestic and international demands, including the elimination of forms of discrimination against women, but its application was in its provisions on the interpretation of legal texts with narrow limits so that its provisions were in favor of women. On the other hand, other countries have sought to amend the laws in favor of women. However, this amendment was not voluntary, but was done as a result of international and internal pressures on international organizations and human rights organizations, as well as on women's efforts and civil society organizations. Women and subjected to serious violations amounting to murder or permanent disability
