WOMEN ADDITIONAL PROTECTION IN THE JORDANIAN PENAL CODE IN lIGHT OF THE PRINCIPLE OF GENDER EQUALITY

Abstract:

This research highlights an important issue in the Jordanian Penal Code; it is a question of equality between men and women. The Jordanian legislator shows interest in protecting woman in her human capacity, but he has provided additional protection for her. In some cases, the punishment for the crime was increased when the victim was a woman, and in some cases the punishment imposed for the crime was reduced when the woman was the perpetrator of the crime, This interest, which may appear to be exaggerated, conflicts with the principle of gender equality. The principle of equality could not have come to contradict itself. Here is French law. The historical source of Jordanian law does not include such additional protection for the woman. So the research clarified this protection and how it is inconsistent with the principle of gender equality.
